Cash In Your Laptop is committed to making sure all of our clients get the best value for their old, broken or new laptops. By selling us a laptop, requesting a quote, contacting us with our website contact form, printing a shipping label, or using our website in any way you specifically agree to be bound by our terms and conditions below.
The terms and conditions herein expressed constitute the entire agreement between the parties (hereinafter referred to as the “Agreement”). Captions are used only as a matter of convenience and have no legal significance. No waiver by us regarding any breach or default shall be deemed to be a waiver of any preceding or subsequent breach or default.
THESE TERMS AND CONDITIONS ARE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH FLORIDA LAW, AND NO CONFLICT OF LAWS OR PROVISIONS OF ANY JURISDICTION WILL APPLY TO THESE TERMS AND CONDITIONS. BY CLICKING ON THE "ACCEPT" BUTTON BELOW, YOU AGREE THAT ANY ACTION AT LAW OR EQUITY ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS WILL BE FILED ONLY IN STATE OR FEDERAL COURT LOCATED IN ORLANDO, FLORIDA AND YOU HEREBY IRREVOCABLY AND UNCONDITIONALLY CONSENT AND SUBMIT TO THE EXCLUSIVE JURISDICTION OF SUCH COURTS OVER ANY SUIT, ACTION, OR PROCEEDING ARISING OUT OF THESE TERMS AND CONDITIONS AND THE TRANSACTION HEREIN CONTEMPLATED.
CUSTOMER AGREES THAT ISSUANCE OF THE SHIPPING LABEL, THE COSTS OF SHIPPING FROM CUSTOMER TO CASH IN YOU LAPTOP, CUSTOMER PLACEMENT OF THE LAPTOP EN ROUTE TO CASH IN YOUR LAPTOP, AND THE TERMS OF THIS AGREEMENT CONSTITUTES SUFFICIENT VALUABLE CONSIDERATION MAKING THE TERMS AND OBLIGATIONS OF THIS AGREEMENT AND ENFORCEABLE VALID AND LEGAL CONTRACT.
I. QUOTES AND ONLINE QUALIFIED OFFERS:
Quotes are valid for 30 days from the date of issue. Laptops must arrive at Cash In Your Laptop on or prior to the quote expiration date. Laptops received after the quote expiration date are subject to re-evaluation.
Online quotes are qualified estimates pending our physical evaluation. Cash In Your Laptop determines the value of your device based on our in hand analysis, current market prices, wear and tear of each individual piece, cost to repair the item as a whole and other factors that might affect resale value of pertaining item. NO ONLINE OFFER WE MAKE IS BINDING UNTIL WE RECEIVE YOUR LAPTOP (OR ANY OTHER DEVICE) AND EXAMINE IT. Cash in Your Laptop reserves the right to determine the laptop state at our sole and exclusive discretion. Once an order is submitted and an offer issued, online quotes are non-negotiable.
In the event an offer is made using Cash In Your Laptop’s online website and upon inspection of your device, Cash In Your Laptop agrees to pay the full quoted amount. You are legally bound per our terms and conditions to sell the laptop at the agreed upon price.
In the event Cash In Your Laptop recalculates an offer after an item was received and inspected, you will have the option of accepting or rejecting the new offer. If you accept the new offer, you will be paid in normal via the payment method you originally selected when obtaining your online quote. If you reject the new recalculated offer, Cash In Your Laptop will attempt to address any issues or findings with the laptop via email. If an agreement cannot be reached, Cash In Your Laptop will return the Laptop to your registered mailing address. Cash In Your Laptop will give you a period of 14 days after you are presented with a new recalculated offer to accept or reject the new offer. Cash In Your Laptop will send reminders of new offers to your registered email address in this 14 day period. If the new offer is neither accepted nor rejected by you during the 14 day period, the new offer will be deemed to have been accepted by you and you will be paid in normal via the payment method you originally selected when obtaining your online quote. To avoid occurrence of doubt, once any original or new offer is accepted, the sale is final, and no additional changes can be made.
In the event Customer requests that the laptop be returned, Customer understands and accepts that Customer is solely responsible for the risk of loss or damage of/to the laptop while it is being shipped.
In the event laptop received by Cash In Your Laptop is a different brand/model than the information submitted during an online order, Cash In Your Laptop will provide the correct model and corrected price for the received model at the time of the laptop inspection. If Cash In Your Laptop receives an incorrect brand/model that Cash In Your Laptop is currently not offering money for, Cash In Your Laptop will request to recycle the laptop, in lieu of having the laptop returned to Customer at Customer’s cost. Should Customer request that their laptop be recycled, Customer accepts that Cash In Your Laptop shall not issue any payment for recycling the laptop. Cash In Your Laptop will recycle the laptop at no charge to Customer. Should Customer request that a laptop be returned due to Customer error, Cash In Your Laptop might ask return shipping be paid in the form of an emailed prepaid shipping label.
All Customers must be 18 years of age and older. Cash In Your Laptop is unable to issue guaranteed offers or conduct business with any minor under the age of 18 and will not be held responsible for confirmation of Customer’s age, especially when it is a misrepresentation by Customer so as to fraudulently induce Cash In Your Laptop to enter into a transaction with Customer.
Customers must hold full legal ownership of any laptops sent to Cash In Your Laptop. Cash In Your Laptop is unable to accept stolen goods or laptops from third parties without consent and/or proof of ownership. Serial numbers and other identifying information are processed through state and national databases of stolen property. Any laptops identified as stolen property will be handed over to the appropriate law enforcement. Customer contact information will be provided to law enforcement upon an authorized request.
The sale and or shipment Customer’s laptop to Cash In Your Laptop must not violate any law, regulation or statute of any jurisdiction. Customer may not unlawfully transfer or encumber any intellectual property, trademark, copyright, patent, software, license or other legal right or restriction via his/her shipping or selling of the shipped laptop. The laptop must be free of all legal restrictions that would affect the value of the laptop, inclusive of licenses and any export laws. The laptop (including all related materials, software and add on hardware) may not be counterfeited, stolen, or contain harmful or offensive content of any nature. Customer unequivocally agrees to hold Cash In Your Laptop harmless and indemnify Cash In Your Laptop from any and all loss of any nature, including fees, costs, judgments, liens and reasonable attorney's fees, arising from any legal action, threatened or otherwise, based on Customer’s violation of the terms and conditions.
Laptops sent to Cash In Your Laptop become property of Cash In Your Laptop upon receipt and exchange of payment, typically within 24 hours or less from the delivery date and time.
CUSTOMER AGREES TO NOT MAIL IN ADDITIONAL SOFTWARE, RETAIL PACKAGING, CARRYING BAGS, OR PERSONAL GOODS (EXCEPT THE LAPTOP COMPUTER CHARGER AND BATTERY) WITH THE LAPTOP. CASH IN YOUR LAPTOP WILL ONLY RECEIVE THE LAPTOP AND RELATED ACCESSORIES NECESSARY AND CUSTOMER AGREES AND UNCONDITIONALLY ACKNOWLEDGES THAT CASH IN YOUR LAPTOP IS NOT RESPONSIBLE FOR ADDITIONAL EXTRANEOUS ITEMS BEYOND THOSE QUOTED SPECIFIC WITH CUSTOMER'S LAPTOP. UPON ARRIVAL ANY ADDITIONAL ITEMS WILL BE IRREVOCABLY AND IMMEDIATELY DISCARDED. CUSTOMER EXPRESSLY AND UNCONDITIONALLY WAIVES ANY CLAIM FOR ANY MISSING ADDITIONAL ITEMS WHICH MAY HAVE BEEN MAILED IN WITH THE LAPTOP AND AGREES THAT ANY SUCH ADDITIONAL ITEM MAY NOT BE RETURNED AS THEY CANNOT BE ACCOUNTED FOR BY CASH IN YOUR LAPTOP.
Under certain limited circumstances, through no fault of Cash In Your Laptop, and due to circumstances beyond Cash In Your Laptop’s control, the laptop may not be returned; in said instances, Customer agrees to hold Cash In Your Laptop harmless from any loss and inability to return the laptop. CUSTOMER AGREES AND UNEQUIVOCALLY ACCEPTS WITHOUT CLAIM THAT CASH IN YOUR LAPTOP’S LIABILITY SHALL BE LIQUIDATED AND FIXED NOT TO EXCEED THE LAST OFFER ISSUED TO CUSTOMER PURSUANT TO THE TERMS OF THE AGREEMENT.
Payments are sent within 24 to 48 hours of receiving Customers laptop during normal business hours (Monday-Friday, 9 A.M.-6 P.M., excluding weekends and holidays).
Payments sent by U.S. First Class Mail do not include tracking information, delivery confirmation, or a guarantee of delivery time. If you do not receive payment within 14 days of notification, please contact Cash In Your Laptop and the check will be re-issued.
Payments sent by UPS Next Day Air will incur a shipping cost of $20-$30 deducted from the check total. The shipping cost is calculated based on the destination zip code directly from UPS published rates. Cash In Your Laptop is unable to use third party account numbers for shipping charges.
Payments sent by PayPal must be sent to the customer's address provided during the quote process. Cash In Your Laptop is unable to send PayPal payments to third parties and any e-mail address other than that provided with the order submission.
CASH IN YOUR LAPTOP'S BANKING INSTITUTION WILL ONLY HONOR CHECKS FOR 90 DAYS FROM THE DATE ISSUED. ANY CHECK ISSUED BY CASH IN YOUR LAPTOP MUST BE CASHED WITHIN THE AFOREMENTIONED 90 DAY PERIOD. CASH IN YOUR LAPTOP WILL NOT ISSUE NEW OR REPLACEMENT CHECKS AS SUBSTITUTE ANY CHECK THAT MAY HAVE BEEN REFUSED OR DISHONORED DUE TO THE BANK'S POLICY. CUSTOMER ACKNOWLEDGES THAT CASH IN YOUR LAPTOP HAS NO CONTROL OVER THE BANK'S POLICIES AND REGULATIONS.
Shipments of laptops to and from Cash In Your Laptop are paid by Cash In Your Laptop.
Although Cash In Your Laptop is not responsible for packages lost or damaged in transit, Cash In Your Laptop will attempt to assist customers in resolving shipping and insurance claims. Customers agree and acknowledge that Customer are solely responsible for the risk of loss or damage of/to his/her property while it is in transit. Cash In Your Laptop has no control over shipping carriers and its relationship is merely that of shipping client.
CUSTOMER AGREES AND UNEQUIVOCALLY ACCEPTS WITHOUT CLAIM THAT CASH IN YOUR LAPTOP’S LIABILITY SHALL BE LIQUIDATED AND FIXED NOT TO EXCEED THE LAST OFFER ISSUED TO CUSTOMER PURSUANT TO THE TERMS OF THE AGREEMENT.
Laptops containing an excess of odor such as cigarette or tar odor or laptops found containing bug infestations could be subject to reductions of the original online offer.
Cash in Your Laptop is unable to offer additional value for software without original installation CD's, product keys, certificate of authenticities (COAs), or other documents necessary for proper licensing. Cash In Your Laptop is unable to offer additional value for OEM, volume, or academically licensed software. All software will be removed and wiped off the laptop upon receipt.
The customer is responsible for disclosing defects or imperfections including but not limited to missing or damaged parts that hinder the functionality or aesthetic appearance of a laptop. Unless noted, Cash In Your Laptop assumes chargers, batteries, power supplies, and other parts required for basic functionality are included with a laptop.
IN THE EVENT CASH IN YOUR LAPTOP MAKE A MATERIAL ERROR IN ANY REPRESENTATION OF THE EVALUATION, INFORMATION OR OFFERS TO CUSTOMER, CUSTOMER’S SOLE RECOURSE IS TO REQUEST THE RETURN OF THE LAPTOP. IN THE EVENT THAT CUSTOMER ELECTS TO CANCEL THE TRANSACTION PRIOR TO RECEIVING PAYMENT, CASH IN YOUR LAPTOP WILL RETURN THE LAPTOP; HOWEVER, CUSTOMER ACKNOWLEDGES AND AGREES THAT ONCE PAYMENT HAS BEEN ISSUED NO RETURN WILL BE VIABLE OR AVAILABLE. CUSTOMER AGREES AND UNEQUIVOCALLY ACCEPTS WITHOUT CLAIM THAT CASH IN YOUR LAPTOP’S LIABILITY SHALL BE LIQUIDATED AND FIXED NOT TO EXCEED THE ORIGINAL OFFER ISSUED TO CUSTOMER PURSUANT TO THE TERMS OF THE AGREEMENT.
If the customer fails to provide adequate specifications for a laptop and Cash in Your Laptop makes disclosed assumptions, the customer is responsible for verifying the disclosed assumptions (customers will see a note in their quote if assumptions have been made). Failure to verify disclosed assumptions (if they are incorrect) may result in an adjusted offer upon receipt of a laptop.
Laptops missing serial numbers, ESNs, service tags, certificate of authenticities (COAs), BIOS passwords, or other unique identifying information must be disclosed to Cash in Your Laptop upfront with reasonable explanation. Cash in Your Laptop reserves the right to deny quotes to such laptops.
VI. SECURITY AND PRIVACY:
Cash In Your Laptop respects customer privacy by not reselling or distributing any personal information to any third party entered on the Cash In Your Laptop website or given to Cash In Your Laptop Staff.
All laptops received by Cash In Your Laptop will have all data wiped upon receipt. Customer unequivocally understands and agrees that regardless of a re-evaluation, Cash In Your Laptop, in order to test the hard drive of the laptop and secure customer data, deletes all data from all laptops upon arrival to Cash In Your Laptop without exception. Customer unequivocally agrees that, upon shipping the laptop to Cash In Your Laptop, customer has expressly waived any interest and recovery expectation of data. Customer agrees not to send Cash In Your Laptop a laptop that has data on the hard drive customer intends on trying to get back.
Cash In Your Laptop emphatically encourages Customer to remove all date from his/her laptop. Customer agrees to hold Cash In Your Laptop harmless and indemnify Cash In Your Laptop from any loss or injury resulting from his/her failure and our failure to remove such information prior to reselling or recycling the device that you send. Cash In Your Laptop is not responsible for any loss suffered by you due to any data that becomes available to any third party subsequent to the final disposition of his/her laptop. Cash In Your Laptop cannot guarantee that all personally identifiable data or other sensitive or security related information will be removed from your laptop.
Cash In Your Laptop uses e-mail communications through the Cash In Your Laptop website in order to communicate with Customers. Customers understand and agree that the e-mail provided during the order process must be an e-mail that they are able to check and receive e-mails in order to receive order notifications from Cash In Your Laptop during the order process. Cash In Your Laptop archives each order and messages for up to 60 days. At any time Customers can log into their order with the username and password given during the order process in order to view all messages that have been sent by Cash In Your Laptop. In the event of a re-evaluation or change in the original quote to Customer, Cash In Your Laptop will e-mail the customer through the message system on the Cash In Your Laptop website to allow Customer to accept or reject the new quote/offer. IF THE CUSTOMER FAILS TO RESPOND TO A RE-EVALUATION E-MAIL WITHIN 14 CALENDAR DAYS OR AN AGREEMENT IS NOT REACHED WITHIN 14 CALENDAR DAYS DURING WHICH CUSTOMER DOES NOT REQUEST THE LAPTOP BE RETURNED, CASH IN YOUR LAPTOP WILL AUTOMATICALLY ISSUE PAYMENT IN THE AMOUNT OF THE RE-EVALUATED OFFER. ONCE PAYMENT HAS BEEN ISSUED NO REVISIONS OR EXCEPTIONS WILL BE MADE.
Customer may receive one to three follow-up e-mails to any direct e-mail, phone request, or order. Customers can request to be removed from future follow-up contact at any point in time once any and all order(s) have been fulfilled.
Cash in Your Laptop may send users periodic e-mails with information pertaining their order.
VIII. SELF-SHIPPING OPTION:
During self-shipping, Cash In Your Laptop provides the customer with a shipping label. This label allows the customer to ship the laptop in their own packaging. Cash In Your Laptop is not responsible for the packaging or safe shipments of laptops that are sent in by the customer. It is the responsibility of the customer to make sure the packaging they are using will be able to make it to Cash In Your Laptop throughout the shipping process.
CASH IN YOUR LAPTOP ISSUES ONE SHIPPING LABEL PER LAPTOP PER CUSTOMER. LAPTOPS SHOULD BE PACKAGED INDIVIDUALLY WITH ONLY ONE LAPTOP PER BOX PER SHIPPING LABEL. CUSTOMER AGREES NOT SHIP MORE THAN ONE LAPTOP PER BOX AND AGREES THAT CASH IN YOUR LAPTOP IS NOT RESPONSIBLE FOR THE LOSS OF MULTIPLE LAPTOPS SHIPPED IN ONE BOX AND HEREBY UNCONDITIONALLY WAIVE ANY CLAIMS AGAINST CASH IN YOU LAPTOP FOR ANY LAPTOP OTHER THAN THAT FOR WHICH THE SHIPPING LABEL WAS GENERATED FOR.
We reserve the right to modify this Agreement at any time without giving you prior notice. Customer’s use of our website, any of our tools and services, following any such modification constitutes his/her consent to be bound by the Agreement as modified. The last date these Terms of Service were revised is set forth below. Terms and conditions modifying the Agreement are effective immediately upon publication.
